Check first whether his foundations are on the boundary line. sometimes people assume that the new wall itself can be built on the boundary which means of course that the foundations will be in the neighbouring property!

If your CLUED is date from before Oct 1 this year then your LPA are in error.
You can challenge them on this and threaten to take the case to thelocal authority ombudsman!
