Clarification on Double Glazing 800mm Rule for Windows

Hi, I am a new member and hope I can get some advice from double glazing fitters please!

Basically we had our windows fitted 2 years ago. We have noticed the height of the floor to window/frame is very very close to 800mm. As none of the bedroom windows are supplied Toughened glass.

I want to know does the 800mm rule apply at where it meets the sill/Frame or where it meets glass?.
When you measure from floor upwards. If the frame is under 800mm and Window is not?

The fitters have realized they didn't provide the correct glass and will be changing only some panels but only some and saying the other panels are ok as the Glass is above 800mm (despite the Sill and frame are under 800mm ), need some clarification as I think the fitters are trying to avoid changing all the panels. They are Fensa member.
