Hi im changing the switch in the kitchen.
Its a double switch
two lights in the kitchen, each switch works a light each.

I've changed the switch the kitchen lights and down stairs work fine, but the lights up stairs upstairs don't work.

So put the old switch back on , turn the mains back on still nothing upstairs.

turn off the mains for 5 mins then back on upstairs is working.

still got the old switch on at the moment.

there are 2 light breakers in the garage,

I guess its something to do with the common.

any pointers would be appreciated

You say something to do with the common assuming the upstairs is fed from the switch you changed , then you say the lights come on upstairs after 5 minutes.
I would advise you to ask your local registered electrician.
