Soil Stack Vent Inside Property - Please Advise is This Ok?

Hi. A month ago i have moved into a new property. It is a flat located on the first and second (top) floor of the building. My wife recently started complaining about smell it the kitchen area. The kitchen is located on the top floor. I had a look above the shelf which is part of the building construction in the kitchen area and found out the top of the soil stack vent is actually inside the property. I have added the photos and I need some advice please. I dont know what uk law states about soil stack vent but my question is this actually legal? I mean is this construction error? Should the top of soil stack vent be placed outside the property? If yes i can get management agency to sort this out as the building is still on the warranty (new built). Thank you for help

Cant access the pictures, there is a way that it can be vented inside the property using a vavle, which allows air into the pipe but stops smell escapeing.
Usually though the pipe is vented to the outside
