Water coming from "disused" overflow

Hello,
Just had a new bathroom fitted, and since the new suite installed there has been a lot of water coming out of the external overflow. I paid the bathroom fitter cash on completion and, despite an initial promise to "come out and look" he hasn't turned up and is now not responding to calls or texts. Fitter stated that the overflow is the 'old toilet overflow and isn't used anymore' however that doesn't ring true (although I know next to nothing about plumbing).
Observation/experimentation shows that water comes out of the overflow when the toilet has been flushed, and when any other water is drawn either in the bathroom or kitchen, not just when draining/emptying sink etc.
I am in an upstairs maisonette which has a gravity fed system including small hot water tank. I haven't actually moved in yet so goodness knows how much water will come out once I start using the bath and shower. The walkway underneath the overflow is puddling with water, and it is dripping down in front of the property beneath and collecting in a large pool. It more or less dries up overnight (as no water is being used) but becoming a big problem during the day.
Can anyone advise as to what the cause might be please? I expect I will need to call out a professional plumber, but just want some indication of how simple/complicated it will be to sort out.
