Planning Obtained and Work Done but it May Never be Used for That Purpose?

I have found the perfect shop to rent for my first business , the only trouble is the landlord has spent the last 2 years fighting the council to get it changed from A1 to A3 use ,
i am happy to do the work and get a building inspector to agree that we have fulfilled the terms of the planning permission for A3 use and as you can legally use a A3 for A2 or A1

My question is do i HAVE to use it as a A3 first or can i use it for an A1 and still make sure it still is classed as a A3 as the landlord insists ,,,

A3 (restaurant etc) can be used as A1 (shop) without new regulation approvalso yes you can get A3 classification and use as A1 without any permission.
