Neighbours Oak Tree Killed my Project

Hi. Planning/building control advice.
Mature oak tree in neighbours garden with perseveration order on it, but it's 15m from proposed single story extension. Planning are saying foundations need to be minimum of 3m (or 10m piles).
Which is of course totally ridiculous! There is no arguing with these bureaucrats, only interested in covering their own backsides! So that has killed the original project, foundations would cost 3 times the cost of the extension.
So, my question is? Could I build a conservatory (no power no heating) and not have to go down stupid meters into the ground?
