10 day notice letter for Party Wall agreement

Hi

I served a Party Wall notice on my neighbours 12 days ago. They have not responded. We've got a party wall surveyor in place but he is not back until Wednesday next week.

I've phoned RICS and they have said I can give my neighbours the 10 day letter letter that follows the Party Wall notice. This is the letter that you send neightbours when they have not responded to your Party Wall notice. This letter gives them 10 days from the date of the letter to find a surveyor or I can appoint one on their behalf.

Can anyone point me in the direction of a copy of this letter. RICs says there is no formal format but I want to get this right and cannot really wait for our surveyor to come back from holiday as I need to serve it on Monday...

This letter must be served under section 10(4) (b) of the Act. Suggest something like:

Re: The Party Wall Etc Act 1996 and _______ (state properties)

I refer to the notices served upon you under section _____ (depends on the work) of the above act on _____ (insert date).

As we have not yet heard from you, we assume you dissent to the work and will appoint a Party Wall Surveyor. Please ensure that you make an appointment by ______ (ten days from the date the notice expires). If you do not make an appointment, we will make on on your behalf under S10 (4) of The Party Wall etc act 1996.
