Condemned Boiler and Incorrect Diagnosis

Hello everyone. Great site and been a lurker for a long time and now in need of advice.

In a nutshell, we had a leak in our boiler and have BG homecare cover. Engineer said our heat exchanger is leaking and claim refused as they said it has leaked because of sludge. he then condemned the boiler and put a sticker on it
He said due to the age of the boiler we would need a new one installed and would we like a quote from them.

We did get a new boiler installed but not by BG and are in dispute with them over wrong diagnosis.

my brain has been working overtime and came across Gas industry unsafe procedure, so wondering if the engineer was correct on condemning the boiler and followed procedure.

Would a leak from the exchanger be deemed as dangerous and warrant a red sticker ?
