Maisonette insurance above rented flat

Hi to all, I own a first floor maisonette, under me is a rented flat, the landlord sadly passed away and the relative looking after is not really looking after it.
The arrangement we had was: he sorted out the insurance for the whole building and I paid half of the ammout to him.
I believe the property is uninsured at the moment.
If I sort my own insurance for the building would I run into any problems in the case of a claim.
I am thinking I shoukd at least have my own insurance just in case but I don't want to spend the money if not valid at all?
