My extension & my neighbour

by Gummo » Wed May 06, 2020 2:57 pm

Comrades, my next-door neighbour happened to mention that, maybe next year, he intends installing decking over his wee back yard and possible over his single-storey extension.

He said he intends to connect his joists to my extension (23) on one side and to his extension (25) on the other side of his yard - see image (joist indicated in orange). The image I've uploaded is from the own plans for my extension years ago.

Do you reckon he has any right to do this if I don't want this structure attached to my house?

Hi gummo
If your extension wall is on your land i.e. it does not form a party wall, then no he cannot fix into your wall without your permission.

Thanks Stoneyboy. The difficult part is precisely establishing the boundary line. Some one suggested that this could be ascertained from the centre line of the chimney.

Hi gummo
That's as good a way as any and it looks like the face of your extension wall is near enough the boundary line.
The problem is that your gutter is on your neighbours side of the boundary so I would suggest you come to some amicable agreement e.g. they can fix in your wall provided any damage inside or out is rectified.

I'm seeking to ensure that he fixes nothing structural to my wall at all.

Hi gummo
You could try but he could insist that you remove the parts of your roof that are on his side of the boundary line. I.e. gutter and facia.

I doubt it - I don't think he intends to seek approval from the planners or building control.

It seems you got the answer to what you really want.
Anyway, If you are the owner then he can't,

Thanks
