New patio over old?

I have a very old patio that needs re-doing. it has been badly done with the slabs just sitting on sand and soil (no real hardcore). Although its uneven it's been there a long time and is probably quite settled. My plan is to mortar in a brick perrimiter, then lay sand directly on top and then slabs. in other words I would be using the existing pation as a hardcore for the new one - is there any problems with doing it this way?

Do what you like, unless the base is stable and level you are wasting your time.
