Replacing 18 Year old Derelict Decking Without Planning Permission

Hi, would love some opinions before consulting solicitor-
Bought Victorian terrace in Feb. House next door had sundeck, almost 3 meters high but obviously rotten. Assumed it had no PP and would never be replaced. Wrong! New owners have rebuilt it, with 1 m high screen. People on it can look straight into our bedroom, sitting room, conservatory and tiny garden. It also overlooks next door garden. Planning Enforcement says owner has photo and legal doc proof it's been there 18 yrs. We believe it never had PP as it didn't show up on our searches for buying. If we could prove it's been derelict for many yrs could this be reason for demolition? Seems very unfair for illegal ruin, breaking 4 of current building regs, can be resurrected and thus halve the value of our house. Thanks

don't think buiding regs hs anything to do with it
planning has as long as the decking isn't over 240mm high and when your on it your not
overlooking the neighbours

Thanks. Planning enforcement says decking OK as has been there 18 yrs, even though it's been derelict for most of that time. It breaks many current rules being 3 ms tall, covering 100% of their outside area and looking straight into our bedroom, sitting room , conservatory and garden. Never had PP so no documentation for solicitor to find so can't sue them for neg! We're stuffed!
