Party wall Act advise please

As i have mentioned previously my neighbor has already built exactly on the boundary with foundation on our land they did not serve us or the previous owner with a notice we are not happy now if have a dispute and object if a surveyor needs to be called under the Party Wall Act are the party who builds responsible for the costs does anyone know and can I use this act technically the work is not finished any advice please. ( we recently bough the property prev owner was in a home thus did not live at the property the garage has been up about 4 months now :cry:

sonia99,
I think you are going to have to employ a solicitor and get them to write to your neighbours citing the party wall act. In any case you neighbour has no right to build foundations on your land - the solicitor should be able to advise what action you can take.
