Window fitted too small for frame

Hi

Im new to this site and was wondering if someone could give me some advice. We purchased a new build in 2005 as first owners. Our top floor room was always cold and could always feel a draft from the back window. A couple of months ago the rain water started coming in around the frame of the window.

We called a builder in who went up and noticed that the window fitted is actually too small for the frame and there are gaps around the window. The screw fitting from the window to the outside roof is actually visible from the outside and photos were taken.

I have sent an email with the photos to the Building Company that we brought from and they appear to be ignoring our emails. NHBC state that they dont cover this. I have the name of the company who installed the windows however there should have been a certificate which we were not given. Unable to trace the Window installers now so at a standstill.

Anyone have any advice what my next move should be? Surely the windows are covered for 10yrs. Does this still cover the fact that the window fitted was too small. Is this acceptable?

I would be greatful should anyone be able to offer any advice.

I would contact your local consumer association (check on web or phone direc).
However they may tell you to write (not e-mail) to the building company, recorded delivery.
Building companies sub-contract much of the work such as fitting windows, kitchens etc. and they would or should have carried out snagging list.
It is the builders responsibility as they sold you the property and it is up to them to chase the window company and ultimately put the problem right

As you say you bought new build in 2005, and window companies generally give at least 10 year guarantee .

But as I said earlier get in touch with local consumer association and they should give you a reference no to contact them again if you get no further with building firm.
